The general conditions of purchase indicated below, as well as any specific conditions that exist for the purchase of certain products, which shall be duly displayed, where appropriate, on the pertinent screens, constitute the regulatory framework for each contract of sale of goods that shall be formalised through the website. These general conditions shall be applicable to the sale of the products marketed through the website, which may be accessed at the top of the main or home page of this website.
The user and/or customer may directly access the Terms and Conditions, as well as the General Conditions of Website Use and Navigation (Legal Notice), and the corresponding Privacy and Cookie Policy by clicking on the duly identified sections, which may be found at the bottom of our website.
By simply browsing through this website, the user and/or customer fully accepts their content without any reservation whatsoever. In case of disagreement, the user and/or client must abandon this website.

2. Purpose of these general conditions – Customer registration
As indicated, the general conditions of purchase expressed below, as well as any specific conditions that exist for the purchase of certain products, which shall be duly displayed, where appropriate, on the pertinent screens, constitute the regulatory framework for each contract of sale of goods that shall be formalised through this website.
These conditions have been prepared in accordance with current regulations on the matter, among others, Royal Decree 1/2007, of 16 November, approving the restated text of the General Law for the Protection of Consumers and Users, and other complementary laws, as well as Law 34/2002, on Information Society Services, and Law 59/2003, of 19 December, on Electronic Signatures.
To make purchases on www.vegadeyuso.com, the user is required to previously register on the website by filling out a form that may be accessed through the link provided on the aforementioned website. To make purchases on www.vegadeyuso.com , the user must expressly accept these General Conditions of Contract.
The general conditions, as well as any specific conditions of purchase that govern, where appropriate, the acquisition of products and services offered on www.vegadeyuso.com, shall always be those in force at the time when each order is placed.
BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L.may modify these general conditions of purchase any time, upholding, in any case, the commitments previously made to its customers. Such modifications shall be published on the website itself so they may be known to new customers.
BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. reserves the right to remove and prevent access to customers who have debit or unpaid balances with BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L.
3. Purchase of products on www.vegadeyuso.com
3.1. Products.
The website shall display the products for sale at all times along with their characteristics and their retail prices in each section.
Wine or any other product containing alcohol shall only be sold to persons of legal age, who must declare such condition when placing an order.
BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. decides which products it offers customers through the website at all times.
In this way, BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. may add or remove references to the catalogue of products offered on the website www.vegadeyuso.com, honouring in any case the orders placed previously or the duration of any specific campaigns or offers to which it has already committed.
In accordance with current legislation, the sale or service of alcoholic beverages to minors through this website is prohibited.
3.2. Indicated prices
The prices of the products available for purchase are shown in euros and include Value Added Tax (VAT).
3.3. Methods of payment
Payments may be made by credit or debit card through the Redsys payment gateway.
The Redsys Virtual Point of Sale (POS) supports payments with American Express, Master Card, Maestro, Visa and Visa Electron cards. To make payments by card, you must indicate the card number, expiration date, cardholder’s name and surname (as they appear on the card) and CVV code on the card.
The customer’s bank card will be charged the amount of the order at the time of purchase.
To improve protection against potential fraud, the customer must provide his/her card details every time he/she makes a purchase, since BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. neither has access to nor stores the bank details of its customers.
BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. undertakes not to allow any transaction that is illegal or considered as such, and that has or may have the potential to harm. The sale or offer of any product or service that is not in full compliance with all the laws applicable to the buyer, issuing bank, merchant, cardholder, or cards is prohibited.
3.4. Availability
BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. shall only dispatch orders to customers in Spain (Iberian Peninsula and Balearic Islands).
When the order is processed, in the event that the purchased product is not in stock, the customer will be notified electronically, by e-mail, or by phone of the product’s unavailability, and a solution or alternative to the order placed by the customer will be sought.
3.5. Shipping costs
Shipping costs will be paid together with the order amount and will appear itemised on the invoice. Shipping will be free for orders within the Iberian Peninsula and the Balearic Islands.
3.6. Order confirmation
The customer will confirm the order made by clicking the ‘Continue’ button during the payment process. As of this confirmation, the order is firm and final. It will be automatically recorded, and BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. will proceed to deliver it.
The automatic record of the order placed has evidential value in terms of its nature, content and date. The customer’s confirmation of the order implies acceptance of the prices, the description of the products offered, the shipping costs and other conditions of sale for the product, which are included in this document. Once the purchase process is completed, the system will confirm the order placed to the customer through the website itself. This confirmation will also be sent to the email address provided during registration.
The order confirmation and proof of purchase (user’s printout) shall not be valid as an invoice.
The pertinent invoice shall be attached to the order in question and delivered together with it.

3.8. Order delivery times
As indicated above, BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L., through its website, www.vegadeyuso.com, does not ship orders to all of Spain. It only ships orders within the Iberian Peninsula and the Balearic Islands.
Orders will be delivered to the address provided by the customer upon placing the order within 72 working hours (excluding Saturdays, Sundays and holidays), although this period may vary depending on product availability or the delivery address. If the customer is not present at the time of delivery, a notice will be left with instructions to contact the transport agency and schedule a new delivery time. Several delivery attempts may be made on consecutive days, after which the order will be returned to BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. After the end of this period, if the customer claims his/her order, he/she will have to pay the shipping costs again.

Failing this, the order shall be delivered to the person of legal age who is at the indicated address at the time of delivery. The customer expressly authorises BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. to deliver the order to him/her. The order recipient must sign the corresponding delivery note, providing his/her name and ID or similar, which implies acceptance of the products received in terms of both quantity and quality and the condition in which they are found.
To this end, the recipient may review the order as much as he/she wishes at the time of receipt in order to show his/her agreement with it. If the order is incomplete, he/she must expressly state this on the corresponding delivery note.
3.9. Proof of transactions
The acceptance of the order by BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. as well as the information related to any transaction involving the corresponding order number and other documentation generated will be stored and filed, serving as evidence in case of litigation.
4. Return of products
4.1. Right of withdrawal
The customer will have a maximum period of fourteen (14) calendar days from the delivery of the product to completely or partially cancel the purchase of the product, in accordance with the applicable legislation.
However, pursuant to Article 102.1 and 2 of Royal Legislative Decree 1/2007, of 16 November, which approves the restated text of the General Law for the Protection of Consumers and Users, and other complementary laws, the right of withdrawal may not be exercised with bottles that have been opened, or, in the case of products delivered in wooden boxes, when the latter have been opened or unsealed. Also, the right of withdrawal may not be exercised in the case of personalised products.
After the period of fourteen (14) calendar days has ended, BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. will not accept product returns based on the right of withdrawal.

In any case, in order to cancel a purchase, the following requirements must be met:
- The product must be in the same condition in which it was delivered and be returned with its original packaging and labelling.
- The item must be returned to BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. in the same box in which it was delivered, or failing this, in a similar format that guarantees the products’ return in perfect condition (except in the case of wine bottles delivered in wooden boxes, which may only be returned in the same unopened box).
- To exercise your right of withdrawal, the physical return of the product is not enough; rather, you must communicate your intention to exercise that right of withdrawal to us in advance. Such communication must be sent to the email address exportwine@vegadeyuso.com
, through physical delivery with proof of the date of receipt at the address indicated above, always within the aforementioned period of 14 calendar days. BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L.. will confirm receipt of your return.

In the case of a cancelled purchase, the refund will include all shipping costs paid by the customer upon making the purchase. However, BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. may charge additional shipping costs in the event of an unusual shipping method or urgent delivery.
In any case, in the event of a cancelled purchase, the customer will bear the cost of returning the products to BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L.
4.2. Return of defective products
Without prejudice to any other rights that may correspond to him/her, the customer shall be entitled to a refund of the price of defective products or products delivered if they do not match the order placed by the user. Alternatively, the user will have the right to file a complaint and receive an equivalent product to the one requested, in perfect condition.
In the cases of returns to BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. of defective products or products that do not match the order placed, the customer must follow the return procedure described in section (4.1) above, although in this case, the customer will not be responsible for the cost of returning such products.
Provided that the user has followed the procedure established in section (4.1) above and the requirements established in this section have been met, BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. will refund the price paid for returned products that are defective or that do not match the order placed by the customer, in accordance with the provisions of section (4.3) below.
4.3. Refund of the price of the products
Provided that the customer has followed the procedure established in this section and the requirements stated therein have been met, BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. will refund the price paid by the customer for the returned products and the shipping costs, except in the case of unusual shipping methods or urgent delivery. In the event of returns made in exercise of the user’s right of withdrawal, described in section (4.1), BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. shall not pay or cover the expenses and/or costs of returning the product to BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L.
The customer shall not be entitled to a refund of the price of returned products that are not in the same condition in which they were delivered, or if the requirements stated in these General Conditions have not been met.
In the case of partial returns of an order, the refund will consist of the price corresponding to the product or products actually returned.
BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. shall process the refund of the order through the same payment system used by the customer to purchase the products, within fourteen (14) days of receipt of the returned order, and once BODEGAS Y VIÑEDOS VEGA DE YUSO, S.L. has verified that the returned products meet the requirements stated in sections (4.1) and (4.2) above. The bank shall be responsible for crediting the refund to the customer’s account.

7. Applicable legislation. Submission to jurisdiction.
This contract will be governed by Spanish legislation, which shall be applicable in all matters not covered in this contract with regard to interpretation, validity and execution. Any disputes derived from the contract of products through this website shall be submitted to the competent jurisdictional bodies determined by law.
